1. Your agreement with us
These terms apply to the surfacing and associated work described in our written quotation.
Your contract consists of the accepted quotation, agreed specifications, these terms and any subsequent changes agreed in writing. We will provide these documents before you commit to the work.
A booking is confirmed when we accept your order in writing. Paying a deposit does not remove any cancellation rights you have by law.
Nothing in these terms limits your statutory rights. Where you are a consumer, our services must be carried out with reasonable care and skill, and materials must meet the applicable legal requirements.
2. Quotations and specifications
Unless stated otherwise, quotations remain open for acceptance for 30 days.
Our quotation will identify the proposed surface, approximate area, preparation and groundworks, edging, drainage, colours, intended use and total price, including VAT where applicable.
Only the work described is included. An estimate is an approximate price; a document described as a quotation is the agreed price for its stated scope, subject to changes agreed under section 3.
Photographs, samples and digital designs illustrate the proposed appearance. Natural aggregates, recycled rubber and production batches can vary in colour and texture. We will discuss any significant expected variation before installation.
A sample or illustration does not override an expressly agreed specification or description.
3. Changes and unexpected site conditions
Changes to the layout, materials, area or specification must be agreed in writing, including any effect on price and timing.
If excavation or preparation reveals an unexpected issue—for example, unsuitable ground, hidden foundations, buried services, contamination or inadequate drainage—we will explain the problem and propose a solution.
We will obtain your agreement to additional charges before carrying out additional work. If agreement cannot be reached, we will discuss how the project can safely be paused, revised or ended, with a fair account of work completed and costs incurred.
We may take proportionate immediate steps to make an unexpected hazard safe, and will notify you promptly.
4. Access and customer responsibilities
Please provide safe access to the work area and tell us about known underground services, drainage, access restrictions or other relevant site conditions.
Before work begins, please remove vehicles, movable furniture and other belongings from the agreed work area. Keep children, pets and visitors away from installation areas and equipment.
Any requirement for water, electricity, storage or parking will be agreed beforehand.
Please note that by accepting our quotation you confirm that you are responsible for permissions, landlord consent, planning matters or other approvals. You must obtain approvals allocated to you before work starts. We remain responsible for the accuracy of advice and work we undertake.
If access or preparation differs materially from what was agreed, we will discuss any necessary changes rather than impose an automatic charge.
5. Existing surfaces, bases and drainage
Where our work involves an overlay, the performance of the new surface depends partly on the existing base and drainage.
We will carry out the checks appropriate to the agreed work, explain any identified concerns and advise where additional preparation is necessary. A visual inspection cannot reveal every concealed defect.
Our additional guarantee does not cover failure caused solely by a concealed defect in a base installed by others. This does not exclude responsibility for our own preparation, unsuitable installation advice, or defects we should reasonably have identified.
Where we construct the base or drainage, defects caused by our materials or workmanship remain covered.
A permeable top surface does not by itself guarantee that the underlying ground or drainage system will absorb water at the same rate.
6. Installation dates and weather
We will agree an installation programme and tell you whether dates are estimated or expressly fixed.
Rain, frost, temperature, moisture and other site conditions can affect whether a surface can be installed correctly. We will explain any necessary postponement promptly and arrange a revised date.
We will take reasonable steps to minimise delays. This clause does not permit indefinite postponement or remove your rights where an agreed deadline is missed.
Please tell us before booking if completion by a particular date is essential.
7. Installation and completion
We will use suitably competent staff and may engage specialist subcontractors or machinery operators. We remain responsible for work they undertake as part of our contract.
We will take reasonable care of your property, keep the site reasonably tidy and remove waste included in the quotation.
Hand-finished surfaces may have minor variations in texture and appearance. These must remain consistent with the agreed specification and must not amount to defective workmanship or an unacceptable safety issue.
At completion, we will offer a handover inspection, explain curing times and provide relevant care instructions. Please notify us of concerns promptly; accepting handover does not remove your rights concerning defects discovered later.
8. Payments
The quotation will state the deposit, any stage payments and the final payment date.
Deposits form part of the contract price. They are not automatically non-refundable.
Stage payments will relate to agreed stages of the work. If there is a genuine dispute, please explain it promptly so we can investigate. Undisputed amounts remain payable under the agreed schedule.
If an undisputed payment is overdue, we may give written notice and a reasonable opportunity to pay before suspending further work, provided the site can be left safely.
No additional work will be charged without agreement, except proportionate emergency safety measures described in section 3.
9. Consumer cancellation rights
If you are a consumer and the contract is made at your home, online or by telephone, a statutory cooling-off period may apply.
We will provide the cancellation notice and form appropriate to your contract before you commit. For a qualifying service contract, the cancellation period normally ends 14 days after the contract is made.
If you want work to begin during that period, we will obtain your express request in writing. You may still cancel before the service is fully performed. Where the legal requirements have been met, you may have to pay a proportionate amount for the service supplied up to cancellation.
Your right to cancel a service contract ends upon full performance during the cancellation period only where you expressly requested early performance and acknowledged that consequence.
The cancellation rules for contracts involving both goods and services can differ; your supplied cancellation notice will explain the applicable arrangements.
10. Other cancellations
If you cancel outside an applicable statutory cancellation right, we may charge only a fair amount for losses directly resulting from the cancellation, subject to applicable law.
We will take reasonable steps to reduce those losses, account for costs saved and explain any deduction from money already paid. Any remaining balance will be refunded.
If we cancel because we cannot deliver the agreed work, we will refund payments for work not supplied and respect any further legal rights you have.
11. Five-year installation guarantee
Unless a different arrangement is clearly stated in your quotation before acceptance, our installed resin-bound, wet-pour rubber and bonded rubber-bark surfaces carry a five-year guarantee.
The guarantee runs from the recorded installation completion date and covers defects in the materials we supply and our installation workmanship under the agreed intended use.
Examples may include premature loss of bonding, delamination or surface breakdown attributable to defective materials or installation.
If a covered defect occurs, we will investigate and provide an appropriate repair or replacement of the affected work, including necessary materials and labour, without charge.
This additional guarantee does not replace or restrict your statutory rights. Those rights may continue beyond the guarantee period.
Any separate manufacturer’s warranty will be identified and supplied where applicable. This guarantee is not described as insurance-backed unless we expressly provide that cover in writing.
12. Guarantee limitations
The additional guarantee does not cover damage to the extent it is caused by:
-
Loads, vehicles or activities exceeding the use or limits agreed in your quotation.
-
Impact, vandalism, deliberate damage or unsuitable sharp objects.
-
Unprotected jacks, stabilisers or other concentrated loads.
-
Wheel spinning, damaging stationary steering or tracked machinery outside the agreed use.
-
Fuel, oil, solvents, chemicals, excessive heat or other contamination.
-
Cutting, excavation, alterations or repairs carried out by others.
-
Failure to follow reasonable written curing or maintenance instructions, where that failure caused the problem.
-
Tree-root growth, movement or failure in a base installed by others, where this was not caused or contributed to by our work.
-
Exceptional external events, such as flooding or fire, unrelated to a defect in our materials or workmanship.
Normal gradual wear, minor natural colour variation, expected weathering and cosmetic changes are not themselves defects. Premature deterioration caused by faulty materials or installation remains covered.
Ordinary weather exposure and ordinary use within the agreed specification do not automatically invalidate the guarantee.
An exclusion affecting one damaged area does not automatically cancel cover for unrelated areas.
13. Loose-fill rubber bark
Loose-fill rubber bark behaves differently from a bonded surface. Movement, displacement and the need for redistribution or topping up are expected.
Our guarantee covers defective materials supplied and defective installation work. It does not guarantee that loose bark will remain fixed in position or retain its original depth without the owners maintenance.
We will provide the agreed installation depth and relevant maintenance instructions. Weed suppression does not mean that weeds can never appear.
14. Rubber safety surfacing
Where impact-absorbing surfacing is specified, the quotation will identify the agreed system, depth, intended equipment and any relevant performance requirements.
Independent testing or certification is included only where stated in the quotation.
The surface must be inspected and maintained appropriately. It cannot prevent every injury. Changes to play equipment, fall heights or site use may require a review of the surfacing specification.
15. Care and maintenance
Follow the written instructions supplied at handover, including curing times and restrictions on use.
Routine care may include removing debris, keeping drainage clear, cleaning using approved methods and inspecting for damage. Loose-fill bark may require redistribution and topping up.
Please ask before using aggressive cleaning equipment, chemicals or repair products. A maintenance issue will affect guarantee cover only where it caused or materially contributed to the defect being claimed.
16. Making a guarantee claim
Contact us at emailus@rubberworxsafetysurfacing.co.uk, with the installation address, completion date or quotation reference, a description of the concern and photographs where practical.
Please notify us reasonably promptly and allow a reasonable opportunity to inspect the surface and resolve a covered issue. A minor delay in reporting does not automatically invalidate a claim.
Avoid unnecessary disturbance of the affected area. If urgent action is needed to prevent injury or further damage, take reasonable safety measures and tell us as soon as possible.
Local repairs can differ slightly in colour or texture because of ageing and batch variation. We will seek a reasonable match and ensure the repair performs as required.
The original guarantee end date normally remains unchanged following a repair, without limiting rights relating to the repair itself.
17. Liability
We are responsible for loss or damage caused by our breach of contract or failure to use reasonable care and skill, in accordance with applicable law.
We do not exclude liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded.
Any separate commercial limitations must be expressly agreed in writing and must comply with applicable law.
18. Photographs
We may take photographs to record the condition of the site and our work.
We will seek separate permission before using identifiable images of your property for marketing. Declining marketing permission will not affect your installation or guarantee.
19. Complaints and disputes
Please send complaints to emailus@rubberworxsafetysurfacing.co.uk. We aim, where possible, to acknowledge them within seven working days and explain the investigation and proposed next steps.
If we cannot resolve a consumer complaint, we will provide information about an appropriate certified alternative dispute resolution provider where required, and state whether we will participate.
Nothing in these terms prevents either party from using the courts or exercising legal rights.
20. Commercial contracts and applicable law
For councils, schools, businesses and other commercial organisations, separately agreed purchase-order or commercial contract terms may apply. Any differences should be resolved in writing before work begins.
For consumers, these terms do not remove protections available under the law of their home jurisdiction or their right to bring proceedings in an appropriate local court.
